Terms of Use

For the purposes of these Terms of Use, the following definitions apply:
“Platform”: the website letters.kazantzaki.gr and any individual page, subpage, service, or function thereof.

“Museum”: the Nikos Kazantzakis Museum, which is the owner, managing body, and lawful provider of the Platform.

“Content”: any information, data, image, text, transcription, translation, documentation, logo, mark, copyrighted work, software, or material displayed or provided through the Platform.

“Services”: any service or function provided through the Platform, including search, display, reading, and use of the Content.

“User” or “Visitor”: any natural or legal person who visits the Platform or uses its Services, regardless of whether they communicate with the Museum.

The Nikos Kazantzakis Museum (hereinafter the “Museum”) has created the website letters.kazantzaki.gr (hereinafter the “Platform”) in order to offer information and services to users regarding the digital collection of Nikos Kazantzakis’s correspondence.

Use of the Platform by the visitor/user implies automatic acceptance of these Terms of Use, which apply to all of the Platform’s Content (pages, graphics, photographs, files, etc.).

The Museum reserves the right to unilaterally modify the Terms of Use and any integral part thereof at any time without prior notice. The Museum will publish the version of the Terms of Use in force at any given time so that visitors/users may be informed. Continued use of the Platform after any changes signifies the visitor’s/user’s unconditional acceptance of the modified Terms of Use.

1. What information and services the Platform offers

The Platform includes archival and historical material—namely letters written by Nikos Kazantzakis—made available to the public as digital copies accompanied by their transcription, translation, and basic documentation (hereinafter the “Content”), for the purpose of highlighting the importance of epistolary writing for the study of the author’s life and work.

The Platform offers advanced search capabilities enabling visitors/users to locate letters based on sender, recipient, referenced persons or locations, as well as to search within descriptions, transcriptions, and translations.

The visitor/user acknowledges that:

  • the Content may contain inaccuracies, omissions, or errors due to the nature of archival material, illegible elements, or differing scholarly approaches;
  • the Museum reserves the right to update, correct, or revise transcriptions, documentation, and related information at any time;
  • the Museum bears no responsibility for interpretations, historical conclusions, or other uses made by the user based on the material.

2. What I can do with the Platform’s Content

The Museum encourages the private use of the Platform’s Content for personal information, as well as use for educational or research purposes. Use within a business, service, or organization does not constitute private use.

For educational or research purposes only, reproduction or storage of individual pages or data is permitted, provided that the source (https://letters.kazantzaki.gr/) is properly indicated and the names of creators (if displayed on the Platform) are cited, without infringing any industrial or intellectual property rights.

However, visitors/users should be aware that certain files or data may be the intellectual property of third parties (partner institutions, organizations, companies, etc.) and may not be used without their permission (which may be indicated on the Platform). Access to or use of the Platform does not grant the visitor/user any rights or licenses to its Content beyond those explicitly stated in these Terms of Use.

If a visitor/user wishes to use the Content under different terms, they may contact the Museum’s Archive via the contact form or by email at info@kazantzaki.gr to obtain the appropriate permissions in accordance with the Archive’s regulations.

If the visitor/user sends messages or information through the Platform’s contact form or via email, they declare and guarantee that the material sent does not infringe third-party intellectual or industrial property rights, does not contain illegal, offensive, defamatory, threatening, or malicious content, and does not contain viruses, malicious code, or harmful elements. The Museum is not responsible for content sent by visitors/users and is not obliged to retain, respond to, or use such content. Data sent are used solely for the purpose of serving the visitor/user, in accordance with the Privacy Policy.

3. What use of the Platform and its Content is prohibited

With regard to the Platform’s Content, strict prohibition applies to storing, reproducing, republishing, transmitting, or distributing any part of the Content for commercial purposes or for any use that does not constitute personal information use and/or educational or research use as described in section 2 above.

It is also strictly prohibited to store, reproduce, republish, transmit, or distribute the Museum’s registered marks or service marks, as well as marks of partner organizations displayed on the Platform.

4. Applicable intellectual property rights

Except where explicitly stated otherwise (third-party intellectual property rights, partners, and contributors), the Platform contains content that constitutes intellectual property of the Museum, which manages the Platform and is protected under Greek and EU law, as well as relevant international conventions.

Such content includes, without limitation, texts, images, designs, graphics, videos, software applications, and services, as well as logos, trade names, trademarks, and distinguishing features belonging to the administrator and/or the persons identified on the Platform as holders of the respective rights, all of which are protected under intellectual (industrial and copyright) property law.

Any violation of the Museum’s or third parties’ intellectual or industrial property rights incurs liability for the visitor/user and entitles the Museum to exercise all legal means to protect its rights, including claims for damages.

5. What obligations I have as a visitor/user of the Platform

Visitors/users must comply with applicable Greek, European, and international law and make lawful and appropriate use of the Platform, observing these Terms of Use.

The visitor/user must refrain from any unlawful, unethical, unfair, or abusive use of the Platform’s Content and Services (indicatively: mass or systematic downloading, storing, or copying of Content beyond permissible private, educational, or research use; attempts to circumvent or breach any technical security measure, access restriction, or copyright protection, etc.).

Any damage caused to the Platform or to the Museum, or to the network more generally, due to unlawful, improper, or abusive use of https://letters.kazantzaki.gr/ by a visitor/user is the sole responsibility of that visitor/user. The Museum reserves all legal rights to protect its interests, and the violator must compensate the Museum for any resulting damage.

Each visitor/user must take all appropriate security measures (e.g., antivirus software) before downloading anything from the Platform. Any cost for repairs or corrections is borne exclusively by the visitor/user; the Museum bears no responsibility or obligation. The visitor/user is responsible for obtaining access to the Platform, which may require payment of fees to third-party providers (e.g., Internet service providers, data usage charges). The visitor/user is solely responsible for such fees, as well as for the personal equipment necessary to access the Platform.

6. How continuous access to the Platform’s Content is ensured

The Museum makes every effort to maintain and provide the Platform and its Content. However, it cannot guarantee uninterrupted or error-free operation, nor that errors will be corrected. The Museum makes every effort to protect the Platform from malware, but it does not guarantee that the Platform or the servers providing its Content and Services are free of viruses or other harmful components.

In any case, the Museum bears no responsibility for any damage that may occur to the visitor/user or to third parties arising from or related to the operation or non-operation or use of the Platform, or inability to provide services or information. Furthermore, the Museum reserves the right to modify or temporarily or permanently discontinue all or part of the Platform with or without notice, as its availability depends on factors beyond the Museum’s control.

7. To what extent the Museum is responsible for the Platform and its Content

The Museum states that it makes every possible effort to ensure that all Platform content, pages, services, and information are characterized—so far as possible—by accuracy, clarity, correctness, completeness, timeliness, and availability; however, it does not guarantee absolute accuracy, completeness, or updating of the Content, and is not responsible for potential errors, omissions, or oversights.

In any case, the Museum bears no liability to the visitor/user for any damage arising from the non-updating of provided information, nor for misinterpretations, incorrect conclusions, or improper use of the Content.

Additionally, for the convenience of visitors/users, the Platform may contain links (hyperlinks, etc.) to third-party websites, whose providers bear full responsibility for the legality, safety, and validity of their content. The Museum has no liability for users’ interaction with those websites solely through their presentation on the Platform, nor does it guarantee their content, privacy policy, completeness, quality of services, or safety.

8. How the Platform protects visitors’/users’ personal data

Personal data submitted by visitors/users when sending electronic messages via the Platform’s Contact section are included in the Museum’s records, used exclusively for the purpose of serving and informing the visitor/user, and are never reproduced or made available to third parties.

For more information regarding the personal data of visitors/users, the Platform’s Privacy Policy is provided, which constitutes an integral and binding part of these Terms of Use.

9. Additional legal terms

Any provision of these Terms of Use that becomes contrary to law shall cease to be valid automatically, without affecting the validity of the remaining terms.

These Terms constitute the entire binding agreement between the Museum and the visitor/user of the Platform and its Services.

No modification of these Terms shall be considered valid or shall form part of this agreement unless it is made in writing and incorporated into these Terms of Use.

These Terms of Use, as well as any amendment thereof, are governed by and interpreted in accordance with Greek law, EU law, and relevant international conventions. The courts of Heraklion have exclusive jurisdiction over all disputes.
